Please read these Terms of Service carefully before using GeneStory's website, mobile applications, or genetic testing services. By accessing or using our services, you agree to be bound by these terms.

2. Acceptance of Terms

By creating a GeneStory account, purchasing our services, or using our website or applications, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, please do not use our services.

For genetic testing of individuals under 18, a parent or legal guardian must accept these Terms on the minor's behalf and provide the required parental consent.

3. Our Services

GeneStory provides AI-powered DNA analysis services including:

• DNA collection kit delivery and sample processing
• Genetic sequencing and variant analysis
• Health predisposition and wellness reports
• Ancestry and heritage analysis
• Pharmacogenomics (drug-gene interaction) reports
• Ongoing access to your results via our secure online platform and mobile application
• Optional genetic counseling referral services

Our reports are intended for informational and wellness purposes. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making health or medical decisions based on your GeneStory results.

4. Account Registration

To access our services, you must create a GeneStory account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access at support@genestory-ai.com
• Accept responsibility for all activities that occur under your account

You may not create an account on behalf of another person without their consent, or use false identity information.

5. Sample Collection and Processing

When you purchase a GeneStory DNA test:

• We will ship a collection kit to your registered address within Vietnam
• You are responsible for following the collection instructions carefully to ensure sample quality
• You must register your kit using the unique barcode provided before returning it
• Samples must be returned within 60 days of kit receipt
• Processing typically takes 4–6 weeks from sample receipt at our laboratory
• In the event of sample failure due to insufficient DNA quality, we will provide one free replacement kit

By submitting your sample, you confirm it is your own biological sample (or, in the case of a minor, their sample with appropriate parental consent). Submitting another person's sample without their knowledge and consent is prohibited.

6. Genetic Data and Consent

Your genetic data is yours. By using our services, you grant GeneStory a limited license to process your genetic data solely for the purpose of providing your requested reports and services. This license does not permit us to sell your genetic data or use it for unrelated commercial purposes.

Any participation in anonymized research programs is entirely optional and requires a separate, explicit consent. You may withdraw research consent at any time without affecting your access to clinical services.

7. Payments and Refunds

All prices are listed in Vietnamese Dong (VND) unless otherwise stated. Payment is due at the time of purchase.

• Cancellation before kit dispatch: Full refund within 14 days of purchase
• Cancellation after kit dispatch but before sample return: Refund of the service fee minus shipping costs
• Cancellation after sample is received by our laboratory: No refund, as processing will have commenced
• Technical failure: If your sample fails to produce results due to a laboratory error (not user error), we will re-process a new sample at no charge or issue a full refund at your discretion

Refund requests should be submitted to support@genestory-ai.com with your order number.

8. Intellectual Property

All content on our website and applications, including text, graphics, logos, icons, images, software, and analytical methods, is the property of GeneStory or its content suppliers and is protected by Vietnamese and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for your personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

Your genetic data and personal reports remain your property. GeneStory does not claim ownership of your genetic information.

9. Prohibited Uses

You agree not to use our services to:

• Submit another person's sample without their informed consent
• Attempt to identify individuals from anonymized research datasets
• Access or attempt to access other users' accounts or data
• Interfere with or disrupt our services, servers, or networks
• Use our services for any unlawful purpose or in violation of any applicable laws
• Reverse engineer, decompile, or attempt to extract our proprietary algorithms or software
• Resell or commercially exploit our services without authorization

10. Disclaimer of Warranties

Our services are provided "as is" and "as available." GeneStory makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of our genetic reports. Genetic science is an evolving field, and our interpretations of genetic variants are based on current scientific literature, which may change over time.

We do not warrant that our services will be uninterrupted, error-free, or that defects will be corrected. Your use of our services is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by Vietnamese law, GeneStory shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to decisions made based on your genetic results.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the specific service giving rise to the claim.

12. Governing Law and Disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes arising from or related to these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in Ho Chi Minh City, Vietnam.

13. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, technology, or applicable law. We will notify you of material changes by email and by posting the updated Terms on our website with a revised "Last updated" date. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
